Adopt Resolution 26-34 authorizing funding in the amount of $275,000 for Segment D and $475,000 for Segment E to acquire temporary easements.

PURPOSE

 

A secondary pipeline is needed to deliver treated water to the north and east regions of the District’s service area from the Leonard Water Treatment Plant. Temporary easements are needed to construct a parallel pipeline to increase capacity of the system due to projected growth in the service area.

 

 

RECOMMENDATION

 

The Executive Director and NTMWD staff recommend the Board of Directors:

 

1)                     Authorize the Executive Director to execute a right-of-way acquisition program for the Leonard Treated Water Pipeline No.2, Segment D, Project No. 101-0684-26, with a budget of $275,000, and the Leonard Treated Water Pipeline No.2, Segment E, Project No. 101-0685-26, with a budget of $475,000; and,

 

2)                     Adopt Resolution No. 26-34, “A Resolution Authorizing the Use of Eminent Domain to Acquire Right-of-Way for the Leonard Treated Water Pipeline No.2, Segment D, Project No. 101-0684-26, and the Leonard Treated Water Pipeline No.2, Segment E, Project No. 101-0685-26, and Delegating Authority to Initiate Condemnation Proceedings to the NTMWD Executive Director.”

BACKGROUND

 

PROJECT PURPOSE

                     AD Memo 5241, Resolution 18-45, authorized a ROW acquisition program for Project No. 101-0425-16, Treated Water Pipeline from Leonard Water Treatment Plant to McKinney No. 4 (TWPL1), which encompassed Segments D and E of the pipeline project.

                     TWPL1 is the only means of conveying treated water from Leonard Water Treatment Plant (LWTP) to the North System.

                     LWTP will have increased capacity through both its Phase Three expansion and the LWTP High Service Pump Station - South project.

                     The permanent easements for TWPL1 have the right for two pipelines.

                     A parallel pipeline has been under consideration since the 2010 Capital Improvement Plan Updates as part of the Bois d’Arc Lake program.

 

ADDITONAL EASEMENT REQUEST

                     The Leonard Treated Water Pipeline No. 2 (TWPL2) shall be an 84-inch diameter pipe of approximately 130,400 linear feet.

                     Temporary Construction Easements are required for this project.

                     Easements will be acquired along the general route depicted on the accompanying maps.

 

 

 

SUPPORT SERVICES

                     Employ the firm of Saunders | Walsh, to act as counsel on the acquisition of the properties.

                     Employ an appraiser to provide appropriate reports.

                     Employ a title company to provide professional services related to certain property ownership issues.

                     Employ survey services to perform a title survey for purchase and acquisition, and verify property lines and potential easement locations when necessary.

                     Based on ongoing projects and the need to ensure substantial completion of this project by October 2030, contracted land agents or acquisition company(s) will be employed to assist in easement acquisition. 

 

 

FUNDING

 

Funding for right-of-way acquisition services in the amount of $275,000 for Project No. 101-0684-26 and $475,000 for Project No. 101-0685-26 is to be made available from the Regional Water System Capital Improvement Fund.
