Adoption of Resolution No. 24-34 authorizing funding in the amount of $650,000, to acquire temporary easements and enter necessary landowner agreements, and project name change.

PURPOSE

 

Easements and agreements are needed in order to rehabilitate manholes and pipeline segments within the Rowlett Creek Trunk Sewer Extension.

 

 

RECOMMENDATION

 

The Executive Director and NTMWD staff recommend the Board of Directors:

 

1)                     Authorize the Executive Director to execute a right-of-way acquisition program for the Rowlett Creek Trunk Sewer Extension Rehabilitation and Improvements, Project No. 501-0594-24, with a budget of $650,000; and,

 

2)                     Authorize a project name change from 508-0594-21 McKinney IS Rehabilitation and Improvements to 501-0594-24 Rowlett Creek Trunk Sewer Extension Rehabilitation and Improvements; and,

 

3)                     Adopt Resolution No. 24-34, “A Resolution Authorizing the Acquistion of Right-of-Way for the Rowlett Creek Trunk Sewer Extension Rehabilitation and Improvements, Project No. 501-0594-24.

BACKGROUND

 

PROJECT PURPOSE

                     NTMWD and the City of McKinney accepted the transfer of ownership of the McKinney-owned Rowlett Creek Trunk Sewer to NTMWD’s Upper East Fork Interceptor System by Interlocal Agreement (ILA), approved by NTMWD’s Board of Directors in August 2024, Administrative Memorandum No. 24-6050, Resolution No. 24-28.

                     The aforementioned ILA also provided a project name change from McKinney IS Rehabilitation and Improvements, Project No. 508-0594-21, to Rowlett Creek Trunk Sewer Extension Rehabilitation and Improvements, Project No. 501-0594-24.

                     This project shall rehabilitate 11 manholes and repair and/or replace 2 interceptor segments, within existing permanent easements located within a golf course.

                     The design and construction of prioritized improvements are described and recommended in the fiscal year FY2017, FY2018, FY2019, and FY2020 Condition Assessment Reports.

                     Temporary easements are needed for access and additional workspace.

                     NTMWD is coordinating this project’s work simultaneously with the landowner’s near-term renovation project of the golf course for the benefit of both parties.

                     Agreements may also need to be made with the landowner regarding temporary access, temporary construction, and restoration.

                     The approximate locations are depicted on the accompanying map.

 

 

 

SUPPORT SERVICES

                     Employ the firm of Saunders, Walsh & Beard, Attorneys & Counselors, to act as counsel on the acquisition of the properties.

                     Employ an appraiser to provide appropriate reports.

                     Employ a title company to provide professional services related to certain property ownership issues.

                     Employ survey services to perform title survey for purchase and acquisition and verify property lines and potential easement locations when necessary.

 

 

FUNDING

 

Funding in the amount of $650,000 will be made available utilizing the Upper East Fork Interceptor System Extendable Commercial Paper (ECP) Program as the appropriation source; issuance of ECP notes will occur as cash needs arise.
