Adoption of Resolution No. 24-35 authorizing an amendment to a previously existing land acquisition program to acquire additional property and provide additional funding in the amount of $2,100,000.

PURPOSE
Additional funding and acreage are needed for a new Peak Flow Storage Tank.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors:
1) Authorize the Executive Director to amend a previously executed land acquisition program for the Preston Road Lift Station Expansion, Project No. 501-0559-20, by increasing the acreage to be purchased, and by providing additional funding in the amount of $2,100,000, resulting in the total authorization of $3,600,000; and,
2) Adopt Resolution No. 24-35, “A Resolution Authorizing the NTMWD Executive Director to Acquire Property for the Preston Road Lift Station Expansion, Project No. 501-0559-20”

BACKGROUND
PROJECT PURPOSE
• Ad Memo 5855 and Resolution 22-38, August 2022, approved a Land Acquisition program with a budget of $1,500,000.
• The original design of the Preston Road Lift Station (PRLS) Expansion called for a parallel lift station to be constructed in conjunction with a parallel 121 Force Main to meet 2070 growth projections.
• Current development along the 121 corridor drastically increased costs and design challenges for constructing a parallel Force Main.
• As an alternative, the project team recommends a peak flow storage tank in lieu of a new lift station and parallel force main.
• The Land Acquisition program originally called for the acquisition of 1.2 acres of land for purchase, 0.2 acres of permanent easement and 1.0 acre of temporary easements.
• This amendment recommends approximately 2.76 acres of land for purchase, 0.02 acres of permanent easement and 0.59 acres of temporary easements for acquisition as described in Exhibit “A” (line list).
SUPPORT SERVICES
• Employ the firm of Saunders, Walsh & Beard, Attorneys & Counselors, to act as counsel on the acquisition of the properties.
• Employ an appraiser to provide appropriate reports.
• Employ a title company to provide professional services related to certain property ownership issues.
• Employ survey services to perform title survey for purchase and acquisition, and verification of property lines and potential easement locations when necessary.
FUNDING
Funding in the amount of $2,100,000 for additional right-of-way acquisition services is to be made available from the Upper East Fork Interceptor System Construction Funds.
