Adopt Resolution No. 26-35 authorizing an amendment to a previously approved Right-of-Way acquisition program to acquire additional easements.

PURPOSE

 

Texas Department of Transportation is widening various state roads within Dallas, Rockwall, and Kaufman counties, which requires relocation of existing District easements and pipelines adjacent to TxDOT roadways. This project addresses the acquisition of those easements necessary for the relocation of NTMWD-owned pipelines.

 

 

RECOMMENDATION

 

The Executive Director and NTMWD staff recommend the Board of Directors:

 

1)                     Authorize the Executive Director to amend a previously executed right-of-way acquisition program for the Waterline Relocations Along State Highways in Dallas, Rockwall, and Kaufman Counties, Project No. 101-0607-22, by adding additional permanent and temporary easements; and,

 

2)                     Adopt Resolution No. 26-35, “A Resolution Authorizing the Use of Eminent Domain to Acquire Right-of-Way for the Waterline Relocations Along State Highways in Dallas, Rockwall, and Kaufman Counties, Project No. 101-0607-22, and Delegating Authority to Initiate Condemnation Proceedings to the NTMWD Executive Director.”

BACKGROUND

 

PROJECT PURPOSE

 

                     Texas Department of Transportation (TxDOT) is planning eight different road improvement projects in Dallas, Rockwall and Kaufman counties that will encroach upon existing NTMWD water line easements.

                     To accommodate the road widening and protect NTMWD facilities, it is necessary to relocate NTMWD pipelines outside of the new TxDOT right-of-way.

                     This relocation requires new permanent easements in some instances and only temporary construction easements in others where existing permanent easements provide sufficient area to relocate the pipelines.

                     Ad Memo 5867, Resolution 22-44, authorized a ROW acquisition program for Project No. 101-0607-22, Waterline Relocations Along State Highways in Dallas, Rockwall, and Kaufman Counties (Project), with a budget of $200,000, to relocate a portion of the Mesquite Hailey to Forney 36-inch water line to accommodate the widening of US 80.

                     Ad Memo 5930, Resolution 23-25, amended the Project’s ROW acquisition program, authorizing additional funding in the amount of $1,100,000, additional temporary easement along US 80, and Permanent and Temporary easement for the relocation of a portion of the Tawakoni Water Supply Project West Pipeline to accommodate the widening of State Highway 276 in the Blackland, Texas, area of Rockwall County.

 

 

 

 

                     Ad Memo 24-5982, Resolution 24-02, amended the Project’s ROW acquisition program, authorizing additional funding in the amount of $1,000,000 and Permanent and Temporary easement for the relocation of portions of six NTMWD pipelines and/or facilities between State Highway 205 and US 66 impacted by Farm-to-Market Road (FM) 552 expansion in Rockwall County.

 

ADDITONAL EASEMENT REQUEST

 

                     TxDOT is improving a turn lane at the intersection of FM 1641 and the Interstate 20 service road, requiring the relocation of a section of the Kaufman Water Supply Project West Pipeline in Kaufman County.

                     Approximately 0.51 acres of 20-foot wide Permanent and 1.06 acres of 50-foot wide Temporary easement are required for the relocation of approximately 1,900 linear feet of pipeline.

                     Additional portions of this project may be brought for approval as TxDOT finalizes plans for other road improvements.

                     Easement acquisition costs are subject to TxDOT reimbursement.

                     The route along which these easements will be acquired is shown on the accompanying Map for each of the above projects.

 

 

SUPPORT SERVICES

 

                     Employ the firm of Saunders | Walsh, to act as counsel on the acquisition of the properties.

                     Employ an appraiser to provide appropriate reports.

                     Employ a title company to provide professional services related to certain property ownership issues.

                     Employ survey services to perform a title survey for purchase and acquisition, and verify property lines and potential easement locations when necessary.
