PURPOSE
TxDOT is preparing to widen US Highway 380 from the intersection of Coit Road to the junction of proposed US 380 bypass and University Drive in Collin County. The TxDOT widening project will encroach onto an existing NTMWD water line and easements, requiring the relocation or protection of the water line, valves, and other facilities.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors authorize the Executive Director to execute an engineering services agreement (ESA) as follows:

BACKGROUND
PROJECT PURPOSE
• Maintain protection of existing infrastructure by relocation and other protective measures, such as extending protective casing and relocating the 48-inch water line that parallels the widened roadway.
• The Engineer’s Opinion of Probable Construction Cost for the work involved is $15,870,063. This is subject to TxDOT reimbursement process.
PROJECT COMPONENTS
• NTMWD’s 48-inch bar wrapped concrete cylinder pipe treated water pipeline: Frisco McKinney Pipeline Contract B. The Frisco-McKinney Pipeline was constructed under NTMWD Project No. WCF 01-08 and was placed in service in 2006. Pipe relocation limits are from the future Independence Parkway to Custer Road, approximately 5,200 linear feet of pipeline.
• Coordination with the Town of Prosper with their relocation of 30-inch Bar Wrapped Concrete Cylinder Pipe. The Town of Prosper’s existing water pipeline parallels the District’s pipeline. The relocation of both pipelines benefits from the coordination of alignment corridors, survey, geotechnical investigation, subsurface utility engineering (SUE), and easement acquisition.
• All elements of design FNI have already begun for the Town of Prosper’s pipeline relocation. An interlocal agreement (ILA) between NTMWD and the Town of Prosper will combine both projects into one construction package since both lines are parallel to each other, and both pipelines will be constructed with bar-wrapped concrete cylinder pipes.

• Affected facilities outside of the existing TxDOT right of ways are typically candidates for reimbursement by TxDOT. The consultant will work with TxDOT representatives to establish and agree on the percentage of reimbursement for the project.

CONSULTANT SELECTION PROCESS
• A Sole Source Memo dated February 19, 2026, was approved on February 24, 2026, to use Freese and Nichols, Inc. for the design and construction administration services since they are currently providing design services for the Town of Prosper’s 30-inch transmission water line relocation in the same corridor.

FUNDING
Funding in the amount of $1,297,670 to Freese and Nichols, Inc. is to be made available by utilizing the Regional Water System Extendable Commercial Paper Program as the appropriation source; issuance of ECP notes will occur as cash needs arise. The District anticipates partial reimbursement by TxDOT for this project.
