PURPOSE
This action allows the District to acquire property for the construction of the Clemons Creek Lift Station needed to convey flows to Sister Grove Regional Water Resource Recovery Facility.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors:
1) Authorize the Executive Director to execute a property acquisition program for the
Clemons Creek Lift Station, Project No. 501-0635-24, with a budget of $2,500,000; and,
2) Adopt Resolution No. 26-32, “A Resolution Authorizing the Use of Eminent Domain to Acquire Property for the Clemons Creek Lift Station, Project No.
501-0635-24, and Delegating Authority to Initiate Condemnation Proceedings to the NTMWD Executive Director.”

BACKGROUND
PROJECT PURPOSE
• The Upper East Fork Interceptor System (UEFIS) Regional Capacity Assurance Phase 3 Report, dated November 1, 2023, identified significant growth in northern McKinney, western Anna, and Melissa, resulting in a need for expanded conveyance capacity to the Sister Grove Regional Water Resource Recovery Facility.
• Current flows indicate that the Clemons Creek Lift Station’s (LS) initial phase will be required within the next 15 years.
• Property must be acquired now due to potentially increasing market value and expanding property development in the general area of the proposed LS site.
• Property for the Clemons Creek LS has been identified.
• The proposed site has sufficient buildable acreage to also allow for potential future expansion.
• The general location in which the property will be acquired is shown on the accompanying map.
SUPPORT SERVICES
• Employ the firm of Saunders | Walsh to act as counsel on the acquisition of the properties.
• Employ an appraiser to provide appropriate reports.
• Employ a title company to provide professional services related to certain property ownership issues.
• Employ survey services to perform a title survey for purchase and acquisition, and verify property lines and potential easement locations when necessary.
FUNDING
Funding for property acquisition services in the amount of $2,500,000 is to be made available utilizing the Upper East Fork Interceptor System Extendable Commercial Paper (ECP) Program as the appropriation source; issuance of ECP notes will occur as cash needs arise.
