BACKGROUND

PROJECT PURPOSE

•                     The City of Anna owns and operates the Hurricane Creek Regional Wastewater Treatment Plant (RWTP).

•                     Hurricane Creek RWTP is currently permitted to discharge up to 16 million gallons per day of wastewater return flows.

•                     NTMWD seeks to reuse Hurricane Creek RWTP return flows to help supply the existing and future water demands of its Member Cities and Customers.

•                     Pursuant to the January 23, 2023, Regionalization Agreement between the District and the City of Anna, the District may divert and reuse Hurricane Creek RWTP return flows.

•                     The reuse of wastewater return flows is a recommended water management strategy for NTMWD in the 2026 Region C Water Plan and 2027 State Water Plan.

•                     NTMWD seeks to reuse all current and future planned Hurricane Creek RWTP return flows to help supply existing and future water demands of its current Member Cities and Customers.

•                     NTMWD proposes to file an amendment application with the Texas Commission on Environmental Quality to seek the right to convey Hurricane Creek RWTP return flows for subsequent diversion and use from Lavon Lake (the Application).

•                     Texas Administrative Code requires that water conservation plans accompanying an application for a water right require evaluation of other feasible alternatives to new water development.

•                     NTMWD proposes to supplement the 2024 NTMWD Water Conservation Plan to include analysis of other feasible alternatives in support of the Application.

•                     Employ the firm of Lloyd, Gosselink, Rochelle & Townsend, P.C., to act as legal counsel related to the filing of the application.
