SUBJECT

recommendation

Authorize the Executive Director to execute a Memorandum of Agreement (MOA) in the amount of $207,370 between the United States Army Corps of Engineers (USACE) and NTMWD for the Wylie Water Treatment Plant (WTP) Raw Water Pump Station (RWPS) No. 4 project.

end

PURPOSE

The purpose of this MOA is to provide a mechanism by which the USACE can fund their efforts for the review of a Non-Recreational Real Estate Outgrant permit, which will be a legal document that authorizes NTMWD the use or access to federally controlled real property in proximity to the Lake Lavon Dam to construct Raw Water Pump Station No. 4. This agreement on site selection will in turn allow the submittal of the National Environmental Policy Act (NEPA) and the environmental compliance process for the project.

BACKGROUND

PROJECT PURPOSE

•                     Provide a new raw water pump station with 350 million gallons per day (MGD) pumping capacity with the ability to intake at a depth of 451 feet mean sea level (ft. MSL) elevation from Lavon Lake below the dead pool elevation of 453 ft. MSL. This pump station would provide operational flexibility and meet the goal of long-term reliability and drought resiliency.

•                     Provide transmission mains to convey flow to the north and south mixing area in the Wylie WTP complex and connections to existing transmission mains for operational flexibility.

•                     The Engineer’s current opinion of probable construction cost (OPCC) is $453,000,000.

MEMORANDUM OF AGREEMENT

•                     Authorization of Wylie WTP RWPS No. 4 project will have to go through a Non-Recreation Real Estate Outgrant process with USACE as the project requires use of USACE owned land.

•                     The purpose of the memorandum of understanding (MOA) is to establish procedures, responsibilities, and financial obligations between the USACE and the NTMWD for support of the outgrant process. That process includes all National Environmental Policy Act (NEPA) and environmental compliance processes required for the activities associated with the development and long-term operation of the Wylie WTP RWPS No. 4 on USACE property at Lavon Lake.

•                     The MOA will provide a mechanism by which the USACE can participate in the outgrant process that is required for project approval and outgrant issuance. The MOA will obligate NTMWD to pay all costs associated with that process.

FUNDING

Funding in the amount of $207,370  to the United States Army Corp of Engineers (USACE) is to be made available from the Regional Water System Capital Improvement Fund.
