Authorize amendments to the Personnel Policies Manual with the following Sections:

                     I.                      Employment Practices

                     II.                     Employee Conduct and Safety

                     III.                     Compensation and Reimbursement

                     IV.                     Time-Off Benefits

                     V.                     Health and Related Benefits

PURPOSE

 

Amendments to the Personnel Policies Manual are needed to reflect changes in State and Federal Law, implement best practices, provide clarification, and make minor corrections throughout.

RECOMMENDATION

 

The Executive Director/General Manager and NTMWD staff recommend the Board of Directors amend the NTMWD Personnel Policies Manual as presented.

BACKGROUND

 

                     In April 2015, the Personnel Policies Manual combined many existing personnel related policies adopted by the Board of Directors.

                     The Personnel Policies Manual has been updated five (5) previous times with the most recent amendments being adopted in September 2022.

                     The current proposed amendments fall into three major categories:

o                     Minor changes, corrections, and clarifications

o                     Changes rated to new or existing laws

§                     Inclusion of “pregnancy” as a protected class in accordance with Pregnant Workers Fairness Act (PWFA) and Providing Urgent Maternal Protection (PUMP) For Nursing Mothers Act

§                     Removal of wage deduction for exempt employees in accordance with Fair Labor Standards Act (FLSA)

o                     Changes in line with Best Practices

§                     Changes to Section 1.6 - Criminal Background Check

§                     Changes to Section 1.7 - Arrests, Charges, and Indictments

§                     Clarifications to Section 2.2 - Progressive Discipline

§                     Clarifications to Section 2.3 - Ethics, Gifts, and Conflicts of Interest

§                     Clarification to Section 2.6 - Drug and Alcohol-Free Workplace

§                     Changes to Section 5.3 - Sick Leave Pool

                     On August 9, 2023, the Policy Committee reviewed this item and recommended adoption of amendments to the Board of Directors.

                     Copies of the redline and a clean version of the proposed Personnel Policies Manual are attached.
