PURPOSE
NTMWD owns non-operational property at the 121 Regional Disposal Facility (RDF) separated from the RDF by State Highway 121. A residential developer is acquiring land to the north of this tract. Development is only viable with an additional point of ingress and egress, which must be through the NTMWD property.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors adopt Resolution No. 25-49, “A Resolution for Conveyance of Fee Simple Property to an Abutting Property Owner at 121 Regional Disposal Facility.”

BACKGROUND
PROJECT PURPOSE
• The purpose of this consent agenda item is to authorize the conveyance of a strip of fee simple surplus property to an abutting property owner and to authorize the Executive Director to execute documents necessary for the conveyance.
• NTMWD owns an approximately 20-acre tract of land (western tract) on the west side of State Highway 121, in Melissa, Texas.
• The western tract was part of the original 1993 property acquisition of approximately 1,257.605 acres.
• State Highway 121 separates the western tract from the 121 Regional Disposal Facility.
• A residential developer (developer) is under contract to acquire approximately 148.8 acres abutting the northern edge of the western tract.
• Developer wishes to acquire 0.40 acres from NTMWD to build a roadway to connect the neighborhood to the State Highway 121 service road.
• The roadway shall be dedicated to the City of Melissa and aligns with the City of Melissa’s existing Comprehensive Transportation Plan.
• The residential development is not viable without an ingress/egress point at the State Highway 121 service road.
• Developer agrees to pay market value for the land as determined by an appraisal.
• Developer is scheduled to close on the abutting property in June 2026.
• NTMWD pipeline and site operations and maintenance will not be impeded by the conveyance.
• This land is surplus to the needs of the District.
FUNDING
Funding from the sale of property in the amount of $191,466 will be credited back to the Regional Solid Waste System Capital Improvement Fund.
