PURPOSE

 

These Interlocal Agreements between the North Texas Municipal Water District (NTMWD), Tarrant Regional Water District (TRWD), Upper Trinity Regional Water District (UTRWD), City of Irving (Irving), City of Dallas (Dallas), and Riverbend Water Resources District (Riverbend)  facilitate funding for the studies identified in the August 1, 2025, Final Mediated Agreement with Regions C and D.

 

RECOMMENDATION

 

The Executive Director and NTMWD staff recommend the Board of Directors adopt Resolution No. 26-40, “Resolution Authorizing the Execution of Interlocal Agreements Between North Texas Municipal Water District, Tarrant Regional Water District, Upper Trinity Regional Water District, City of Dallas, City of Irving, and Riverbend Water Resources District Regarding Funding of Studies Identified in the August 1, 2025, Final Mediated Agreement with Regions C and D.”

BACKGROUND

 

                     The Texas Water Development Board (“TWDB”) administers 16 regional water planning areas as part of the state water planning process

 

                     NTMWD participates in and is located in the TWDB Region C water planning area (“Region C”) and contributed to the development of the 2026 Region C Initially Prepared Plan

 

                     On June 26, 2025, the Texas Water Development Board identified an interregional conflict between the 2026 Region C and Region D Initially Prepared Plans, and required the regional water planning groups to engage in mediation to attempt to resolve the conflict

 

                     On August 1, 2025, the mediation resulted in the Agreement Resolving the Declared Conflict Between the Region C and Region D 2026 Initially Prepared Water Plans, which required two studies to be conducted that are related to the Marvin Nichols Reservoir (the “Agreement”)

 

                     Regions C and D will conduct a joint study that will address the potential benefits and impacts of the Marvin Nichols Reservoir and the anticipated associated mitigation land acquisition on the economic, agricultural, and natural resources of Regions C and D (the “Joint Study”)

 

                     Region C will solely conduct a study that will compare monetary and non-monetary elements and effects of the Marvin Nichols and Toledo Bend projects (the “Region C Only Study”)

 

                     Region C appointed North Texas Municipal Water District (“NTMWD”), Tarrant Regional Water District, Upper Trinity Regional Water District, City of Dallas, and City of Irving (the “Parties”) to be members of an interregional working group, which will administer the Agreement along with members appointed by Region D

 

                     The Parties will provide funding for fifty percent (50%) of the cost of the Joint Study, up to a two hundred and fifty thousand dollars ($250,000.00) maximum, and will share in the total cost of the Region C Only Study up to a one-hundred thousand dollars ($100,000.00) maximum

 

                     NTMWD’s total combined contribution to the Joint Study and the Region C Only Study will be $83,175, and costs will be shared among the Parties for each study as follows:

 

o                     Region C contributions to Joint Study

                     NTMWD: $59,375.00 (23.75%)

                     TRWD: $59,375.00 (23.75%)   

                     Dallas: $59,375.00 (23.75%)

                     UTRWD: $59,375.00 (23.75%)

                     Irving: $12,500.00 (5%)

 

o                     Region C contributions to the Region C Only Study

                     NTMWD: $23,750.00 (23.75%)

                     TRWD: $23,750.00 (23.75%)

                     Dallas: $23,750.00 (23.75%)

                     UTRWD: $23,750.00 (23.75%)

                     Irving: $5,000.00 (5%) 

 

                     NTMWD has been designated by the Parties as the entity to collect Region C’s funding in support of the Joint Study and to coordinate with Riverbend Water Resources District (“Riverbend”), which will be responsible for finding, hiring, and paying a consultant to conduct the Joint Study

 

                     NTMWD has been designated by the Parties as the entity to collect Region C’s funding in support of the Region C only study and be responsible for finding, hiring, and paying a consultant to conduct the Region C Only study

 

 

FUNDING

 

Funding in the amount of $83,175 is to be made available in the Regional Water System 2026-2027 Annual Operating Budget.
