PURPOSE
Major amendments to the Bois d’Arc Lake SMP are needed to reflect new administrative processes and procedures, changes to agreement templates, and to provide additional guidance for uses and improvements of the shoreline.
RECOMMENDATION
The Executive Director/General Manager, NTMWD staff and Lloyd, Gosselink, Rochelle & Townsend, P. C., recommend the Board of Directors amend the Bois d’Arc Lake SMP as presented.

BACKGROUND
• In October 2020, Resolution No. 20-53 authorized adoption of a Shoreline Management Plan (SMP) for Bois d’Arc Lake and established Board and staff authorities for implementing and amending the SMP
• Resolution No. 20-53 defines major amendments to the SMP which require Board approval and minor amendments which the Executive Director or their designee are authorized to make
• Since the adoption of the Bois d’Arc Lake SMP there have been ongoing efforts to develop the processes and systems necessary to administer the plan and prepare for future Board action to authorize staff to begin accepting applications and issuing agreements under the SMP
• Major amendments are necessary to reflect current administrative processes, update agreement templates, and provide additional guidance to applicants
• Major amendments to the SMP are described as follows:
o Addition of a new Appendix F that includes detailed standards, guidelines, and submittal requirements for agreement applications
o Clarify that improvements in the flood and flowage easement area may be considered in lieu of on NTMWD property
o Expand Lessee operational and maintenance requirements for shoreline improvements
o Require Lessees to file a new Record of Agreement form with Fannin County rather that a full copy of their agreement with NTMWD
o Modify the signature process for agreements so they are fully executed prior to Lessees accessing NTMWD property
o Miscellaneous updates to standard from agreements in Appendix C - Agreement Templates
• Major amendments to the SMP will substantially conform to the redline version of the SMP attached
• In addition to these major amendments, the attached redline version also contains several minor amendments to the SMP
