PURPOSE
Additional interest in the property has resulted in a reconsideration of the overall property value.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors:
1) Authorize the Executive Director to amend a previously executed land acquisition program for Land for Additional Raw Water Supply, Project No. 101-0667-25, by providing additional funding; and,
2) Adopt Resolution No. 25-42, “A Resolution Authorizing Additional Funding and the Acquisition of Property to Secure Additional Raw Water Supply, Project No. 101-0667-25.”

BACKGROUND
PROJECT PURPOSE
• Administrative Memorandum No. 25-6146 and Resolution 25-28 authorized a Land Acquisition Program for Land for Additional Raw Water Supply, Project No. 101-0667-25, with a budget of $7,750,000.
• Administrative Memorandum No. 25-6155 and Resolution 25-34 authorized additional funding in the amount of $1,300,000 to fund property, legal fees and other support services, resulting in a total budget of $9,050,000.
• The acquisition will secure additional raw water reserves to meet the current and future demand of the service area.
• A contract has not been executed between NTMWD and Sellers.
SUPPORT SERVICES (ON AN AS-NEEDED BASIS)
• Employ the firm of Saunders, Walsh & Beard, Attorneys and Counselors, to act as counsel on the acquisition of the properties.
• Employ the firm of Lloyd Gosselink to act as counsel on water rights and other regulatory issues.
• Employ a title company to provide professional services.
• Employ survey services to perform title surveys for purchase and acquisition, to verify property lines, and potential easement locations when necessary.
• Employ other such professionals necessary to effectuate the purchase and acquisition of the property.

Funding is to be made available in the Regional Water System Capital Improvement Fund
