Adopt Resolution No. 25-28 authorizing funding in the amount of $7,750,000 to make a written offer to acquire real estate located in Red River County, needed to increase raw water supply.

PURPOSE

 

Estimated population growth of current service areas requires additional raw water supplies.

 

 

RECOMMENDATION

 

The Executive Director and NTMWD staff recommend the Board of Directors:

 

1)                     Authorize the Executive Director to execute and deliver a proposed contract to purchase real estate with a budget in the amount of $7,750,000; and,

 

2)                     Adopt Resolution No. 25-28, "A Resolution Authorizing and Delegating Authority to the NTMWD Executive Director to Execute and Deliver a Real Estate Purchase Contract.”

BACKGROUND

 

PROJECT PURPOSE

                     Secure additional raw water reserves to meet current and future demand of service area.

 

SUPPORT SERVICES (ON AN AS-NEEDED BASIS)

                     Employ the law firm of Saunders, Walsh & Beard to act as counsel for the acquisition of the property located in Red River County.

                     Employ the law firm of Lloyd Gosselink to act as counsel on water rights and other regulatory issues.

                     Employ a title company to provide professional services.

                     Employ survey services to perform title surveys for purchase and acquisition, as well as to verify property lines and potential easement locations, when necessary.

                     Employ such other professionals necessary to effectuate the purchase and acquisition of the property.

 

 

 

 

FUNDING

 

Funding in the amount of $7,750,000 is to be made available in the Regional Water System Capital Improvement Fund.
