Adoption of Resolution No. 24-41 authorizing the filing of a permit application for the future Gateway Drive Transfer Station solid waste permit with the Texas Commission on Environmental Quality (TCEQ) and the City of Frisco, and funding in the amount of $488,068 to Weaver Consultants Group, LLC, for an engineering services agreement for permitting the future Gateway Drive Transfer Station.

PURPOSE
Due to the continued growth in the Solid Waste service area, the District has been seeking a site for a fourth transfer station. This action will allow for solid waste permitting to be conducted with TCEQ and the City of Frisco.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors:
1. Adopt Resolution No. 24-41, “An Application authorizing the Filing of a Permit Application for the Gateway Drive Transfer Station Solid Waste Permit, Appointing the Executive Director as Agent for North Texas Municipal Water District in All Matters Concerning Such Permit Application, and Authorizing the Executive Director to Take All Necessary Actions in Furtherance of the Permitting Process.”
The Executive Director and NTMWD staff recommend the Board of Directors authorize the Executive Director to execute an engineering services agreement (ESA) as follows:

BACKGROUND
PROJECT PURPOSE
• NTMWD owns and operates the Lookout Drive Transfer Station, the Parkway Transfer Station, and the Custer Road Transfer Station (Custer Road TS).
• The Custer Road TS receives waste from Allen, Frisco, McKinney, and Plano. The site also hosts the yard waste processing facility for the compost program that serves all five Regional Solid Waste System (RSWS) Member Cities.
• The Custer Road TS is limited by its municipal solid waste permit issued by the TCEQ to accept a maximum of 1,900 tons of waste per day, including yard waste, and is more frequently approaching the daily limit due to the growth of the RSWS Member Cities.
• Frisco currently delivers 92 percent of its waste to the Custer Road TS, and its tonnage is increasing annually.
• Frisco desires to have a waste transfer station sited in Frisco adjacent to their future Environmental Services Center and future Balcones Recycling facility and has identified approximately 14.8 acres owned by the Frisco Community Development Corporation (Frisco CDC) for NTMWD to purchase for this purpose.
• The additional transfer station will receive most of the Frisco waste currently delivered to the Custer Road TS, reducing the strain on that facility.
• Purchase and Sale Agreement with the Frisco CDC provides terms for the purchase of the property, including:
• NTMWD submitting the TCEQ permit application the later of May 31, 2026, or 6 months after receiving all development approvals from the City of Frisco;
• NTMWD commencing construction not later than the earlier of December 31, 2030, or 18 months after NTMWD's receipt of a final and non-appealable permit issued by the TCEQ;
• Property repurchase at 100 percent of the original purchase price if NTMWD fails to commence construction within 90 days of receipt of a construction Commencement Failure Notice by Frisco CDC;
• NTMWD to obtain a permanent certificate of occupancy for the transfer station not later than 30 months from the construction commencement date;
• Temporary Use Restriction restricting the property to be used solely for the transfer station operations for 25 years following sale closing; and,
• Permanent Use Restriction for certain defined prohibited uses stated in the Purchase and Sale Agreement.
• Development Agreement with the Frisco CDC provides tasks the City of Frisco will perform associated with the construction of infrastructure for the transfer station, including:
• Construction of Gateway Drive, Executive Drive, and a portion of Monroe Drive connecting Gateway Drive to Executive Drive;
• Establishment and construction of water and sanitary sewer facilities necessary to serve the property (NTMWD responsibility for electricity and internet fiber);
• Construction of off-site stormwater detention facilities serving the property; and,
• Completion of these construction activities by May 31, 2026.
• Administrative Memorandum No. 24-6044 authorized execution of the Purchase and Sale Agreement and Development Agreement and funding and acquisition of the 14.8-acre tract property from the City of Frisco in the amount of $10,393,377.12.
• Both agreements were executed August 16, 2024.
