Adopt Resolution No. 26-33 authorizing funding in the amount of $3,500,000 to acquire permanent easements for the 48-inch Pipeline Relocation along US-380 near the boundary of City of McKinney and City of Prosper. This is for work associated with the US380 widening and US380 bypass.

PURPOSE
TxDOT is preparing to widen US Highway 380 from the Intersection of Coit Road to the junction of the proposed US 380 bypass and University Drive in Collin County. The TxDOT right-of-way will encroach upon NTMWD easements, requiring the relocation or protection of the facilities. The pipeline relocation is estimated to be about 5,200 linear feet, and the preliminary estimate for total acres of permanent easement is between 3 and 4 acres. The total will be refined as the design advances.
RECOMMENDATION
The Executive Director and NTMWD staff recommend the Board of Directors:
1) Authorize the Executive Director to execute a right-of-way acquisition program for the 48-inch Pipeline Relocation Along US-380, Project No. 101-0691-26, with a budget of $3,500,000; and,
2) Adopt Resolution No. 26-33, "A Resolution Authorizing the Use of Eminent Domain to Acquire Right-of-Way for the 48-inch Pipeline Relocation Along US-380, Project No. 101-0691-26, and Delegating Authority to Initiate Condemnation Proceedings to the NTMWD Executive Director."
